Terms of Use

The following Terms of Use govern use by all Users of ASA Academy Digital Library (or any successor thereto) and the electronic edition of the products subscribed to by an Authorized User or the Authorized User's institution (the “Customer”) under an agreement with us (the “License”), and incorporate by reference of our Privacy Policy, and any guidelines, rules or disclaimers that may be posted and updated on specific web pages of ASA Academy Digital Library or on notices that are sent to you. Please read the following carefully because by using ASA Academy Digital Library you are agreeing to abide by these Terms of Use. Definitions
  1. Authorized Users – As defined in your applicable License.
  2. Electronic Products - All products, services and content available in ASA Academy Digital Library.
  3. Intellectual Property Rights – These rights include, without limitation, patents, trademarks, trade names, design rights, copyright (including rights in computer software), database rights, rights in know-how and other intellectual property rights, in each case whether registered or unregistered, which may subsist anywhere in the world.
  4. Licensed Electronic Products – The Electronic Products which the Customer has licensed.
  5. Users – Users of ASA Academy Digital Library regardless of whether they are unregistered users, Authorized Users, or Customer.
  6. ASA Academy Digital Library - The online service (or any successor thereto) available from ASA Academy or its affiliates including all products, services and features offered via the service. Certain products and services may be delivered from other platforms. The terms and conditions hereof are equally applicable to those products and services.
Copyright The Electronic Products, ASA Academy Digital Library and the Intellectual Property Rights contained therein are protected by law. As a User, you have certain rights specified below; all other rights are reserved. Additional Product License Terms In addition to these Terms of Use, if you or your institution entered into a license with ASA Academy (the “License”), the terms of the License also apply and will control in the event of any discrepancy or conflict between the License and these Terms of Use. Specifically:
  • Instant Access Article / Pay Per View (PPV) License Terms:
    • If you purchase ‘Instant Access’ or ‘Pay Per View’/PPV access to an article, or book chapter, the individual person purchasing will receive a non-exclusive, non-transferable, personal right to access and use the selected work in the format and for the time period selected. Unless the option ‘PDF Full Text and Online Access’ is selected, the Licensed Electronic Products will not be downloadable.
    • Full payment via credit card is required to complete an order. Purchases are non-refundable except in very limited circumstances where the download is faulty, damaged, wrongly described or otherwise refundable under certain consumer laws. We will only consider refunds up to 48 hours following purchase, unless a longer period applies under local law.
  • Institutional License Terms: Your institution may have a license which permits you additional uses; contact your institution's librarian/administrator for more information.
Rules of Use A. To make ASA Academy Digital Library and the Electronic Products useful, the following rules apply:
  1. All Users have to create a My Account Page which will allow them to access the books they have license to view which may be reused by them and manage their custom e-mail alerting services. In order to do so, Users must register. During the registration process, Users will select and register a user name and password which they must keep confidential and not disclose to or share with anyone else.
B. Except as expressly provided above or with respect to material published on an open access basis under a Creative Commons license for which the license terms apply (including the requirement for attribution), Users may not:
  • copy, distribute, transmit or otherwise reproduce, sell or resell material from Electronic Product(s);
  • store such material in any form or medium in a retrieval system;
  • download and/or store an entire issue of an Electronic Product or its equivalent;
  • or transmit such material, directly or indirectly, for use in any paid service such as document delivery or list serve, or for use by any information brokerage or for systematic distribution, whether or not for commercial or non-profit use or for a fee or free of charge.
C. Users agree not to remove, obscure or modify any copyright or proprietary notices, author attribution or any disclaimer as they appear on ASA Academy Digital Library. Users may not integrate material from the Electronic Product(s) with other material or otherwise create derivative works (including resulting from the use of artificial intelligence technologies and tools) in any medium or override any security feature or exclusionary protocol. However, brief quotations for purposes of comment, criticism or similar scholarly purposes are not prohibited herein. D. Users may not do anything to restrict or inhibit any other User's access to or use of ASA Academy Digital Library and the Electronic Product(s). E. If a User refuses or fails to abide by these Terms of Use or violates any other terms of this Agreement, ASA Academy reserves the right in its sole discretion to suspend or terminate their access to ASA Academy Digital Library and the Electronic Products immediately without notice, in addition to any other available remedies. F. Users shall not:
  • Use any scraper, crawler, spider, robot or other automated means of any kind to access or copy this site, ASA Academy Digital Library, the Electronic Products, or any material included therein, deep-link to any feature or content on ASA Academy Digital Library, the Electronic Products, or any material included therein, bypass our robot exclusion headers or other measures we may use to prevent or restrict access to ASA Academy Digital Library, the Electronic Products, or any material included therein;
  • Use or enable artificial intelligence technologies and tools to ingest, train, test, analyze, process, copy, distribute, make publicly accessible, and/or generate output (including resulting from the use of artificial intelligence technologies and tools) based on ASA Academy Digital Library, the Electronic Products, or any material included therein, or upload, copy, or host the ASA Academy Digital Library, the Electronic Products, or any material included therein to or for use in artificial intelligence technologies and tools directly or indirectly (e.g., through the use of third-party plugins, extensions or decentralized custom chatbots associated with those artificial intelligence technologies and tools).
Additional Terms ASA Academy is not responsible for any charges associated with accessing ASA Academy Digital Library and the Electronic Products, including, but not limited to, any computer equipment, telephone or internet connections and access software. Upon payment of an invoice, the products in the invoice are covered by the Customer’s License on the terms and conditions therein. ASA Academy may modify any of these terms and conditions at any time by providing notice on ASA Academy Digital Library. A User’s continued use of ASA Academy Digital Library shall be conclusively deemed acceptance of such modification. ASA Academy Digital Library may provide links to third-party websites. Where such links exist, ASA Academy disclaims all responsibility and liability for the content of such third-party websites. Users assume the sole responsibility for the accessing of third-party websites and the use of any content appearing on such websites. Warranty Limitations ASA ACADEMY DIGITAL LIBRARY AND THE ELECTRONIC PRODUCTS AND ALL MATERIALS CONTAINED THEREIN ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; THE USE OF THE ELECTRONIC PRODUCTS, ASA ACADEMY DIGITAL LIBRARY AND ALL MATERIALS IS AT THE USER'S OWN RISK; ACCESS TO ASA ACADEMY DIGITAL LIBRARY AND THE ELECTRONIC PRODUCTS MAY BE INTERRUPTED AND MAY NOT BE ERROR FREE; AND NEITHER ASA ACADEMY NOR ANYONE ELSE INVOLVED IN CREATING, PRODUCING OR DELIVERING THE ELECTRONIC PRODUCTS OR THE MATERIALS CONTAINED IN ASA ACADEMY DIGITAL LIBRARY, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USER'S USE OF OR INABILITY TO USE ASA ACADEMY DIGITAL LIBRARY, THE ELECTRONIC PRODUCTS AND ALL MATERIALS CONTAINED THEREIN.
